Terms of service.
Effective Date: 12 May 2025
By engaging my services, you agree to the following terms:
1. Services Provided
Ben Cullen provides professional funeral services including, but not limited to:
Funeral celebrancy
Eulogy and speech writing
Photo/video tributes
Order of service and printed materials
Digital media conversion (e.g. VHS/DVD to digital, scanning)
Memorial websites and content
Funeral and end-of-life planning
Design and creation of memorial products
Each service is tailored individually, with specific deliverables and timelines agreed upon at time of booking.
2. Payment Terms
Private Clients:
Full payment is due at time of booking for all services and products.
In some cases, a 25% non-refundable booking fee may be permitted, with the balance due no later than 2 business days before the funeral service.
Late or failed payments may result in cancellation of services and referral to a debt collection agency. A late fee may apply.
Approved Business Clients (e.g. funeral homes):
Payment is due within 7 calendar days of the funeral service.
Non-approved businesses may be required to follow private client payment terms at my discretion.
Continued non-payment after reasonable attempts to collect may result in referral to a debt collector. Additional fees may apply.
All Clients:
Accepted payment methods: bank transfer, PayID, card (tap/pay), or cash.
Cheques are not accepted.
Invoices are issued for transactions over $50. Receipts are available upon request.
3. Cancellations & Refunds
Booking fees are non-refundable.
Cancellations made at least one day prior to the funeral may be partially refunded, at my discretion, depending on services already performed.
Cancellations on the day of or after the funeral are non-refundable.
Refunds are assessed case-by-case and may be subject to deductions based on completed work.
4. Delivery Timeframes
Delivery of services is agreed upon at the time of booking. Due to the personalised nature of each service, delivery timelines may vary. Elements of the service may be delivered in stages.
5. Revisions
Funeral service and eulogy writing: up to 2 rounds of revisions included. Additional changes may incur a fee.
Printed materials: up to 3 drafts/revisions. Any changes after final approval or printing will incur full reprint costs.
Website and digital products: change requests after project completion will attract a management/editing fee.
6. Intellectual Property
All materials created by me (written, visual, or digital) remain my intellectual property. Clients receive a licence to use materials for personal, non-commercial purposes.
Reuse, reproduction, or redistribution requires written permission.
Client names, personal details, and content may be used for marketing or educational purposes only with written consent, as per the Privacy Policy.
7. Subcontractors & Third Parties
Where necessary, I may engage third-party professionals (e.g. printers, web hosts, assistants). Clients will be informed when this occurs, and their costs included in the quoted total.
Websites and memorial products may be hosted on third-party platforms.
8. Liability & Indemnity
Clients and their guests agree to follow any instructions issued by me during services at their own risk. I am not liable for personal injury or property damage.
I am not responsible for:
Venue facilities, AV equipment, delays caused by third parties or weather
Equipment provided by clients or external providers
Acts or omissions of guests or third-party suppliers
In unexpected circumstances (e.g. illness, transport issues), I will make all reasonable efforts to attend the service. If I am unable to do so, I will attempt to organise a suitable replacement celebrant or issue a full refund. I am not liable for losses arising from such cancellations.
9. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes arising shall be subject to the exclusive jurisdiction of Queensland courts.
10. Force Majeure
Neither party is liable for failure to perform due to events beyond their control including natural disasters, acts of war, government restrictions, or power outages.
If a Force Majeure event occurs, all fees already incurred or owing up to that point must still be paid.
